COURT THROWS OUT FALANA’S FRAUD CASE AGAINST ZINOX, OTHERS
A High Court of the Federal Capital Territory, Abuja, has dismissed a fraud case filed against the Chairman of Zinox Technologies, Leo Stan Ekeh; his wife, Chioma Ekeh; and 11 others.
Justice Akpan Okon Ebong ruled that the case, registered under Suit No. CR/985/2024, constituted a "gross abuse of court process" and was therefore dismissed.
The case was originally filed in November 2024 by Senior Advocate of Nigeria, Femi Falana, under a fiat granted by the Attorney General and Minister of Justice, Lateef Fagbemi. Falana had revived an earlier case (Charge No. CR/827/2013) concerning alleged financial misconduct involving the legal adviser of Zinox Technologies, Chris Ozims, and six others.
However, in the refiled case, Falana expanded the list of defendants from seven to 13, including individuals and corporate entities such as Technology Distributions Limited and Zinox Technologies Limited.
Justice Ebong criticized this expansion, stating that Falana had overstepped his authority. He remarked, “The mere fact that a lawyer has been granted a fiat by the HAGF does not turn him into a Knight Errant, like Don Quixote, going everywhere looking for suspected criminals to prosecute.”
The judge ruled that Falana had no authority to modify or expand the charges, declaring the case an abuse of court process. He also noted that law enforcement agencies had found no merit in the complainant’s allegations against the defendants.
With this ruling, the case against Ekeh and others has been formally dismissed.
